Terms and Conditions

Last updated: October 26, 2026

These Terms and Conditions govern the contracting of services provided by Blinq through blinqoficial.com. By accepting a quote or making the first payment, the client declares that they have read and accepted them.

1. Identification of the provider

  • Trade name: Blinq (Blinq Oficial)
  • Address: Bogotá, Colombia
  • Website: blinqoficial.com
  • Email: blinqoficialcontact@gmail.com
  • WhatsApp: +57 311 279 5688

Blinq is the trade name under which the services described in this document are provided. The full identification details of the parties — name or business name, ID number and address — are set out in the quote the client accepts, which forms an integral part of these Terms, and are provided to anyone who requests them through the contact channels.

2. Purpose

Blinq provides digital design, development and operation services. Its current catalog is published at blinqoficial.com and includes, among others: AI-powered websites (landing pages, business websites and online stores), artificial intelligence assistants for websites and WhatsApp, digital advertising (campaign management on Meta and Google), brand identity, custom software (ERP, CRM, point-of-sale systems and SaaS platforms) and the monthly care plan for web projects. The specific scope of each engagement is solely what is detailed in the quote accepted by the client, regardless of the services Blinq offers in its catalog.

The demos published on the site — such as the sample websites and the early version (demo) of Blinq POS — are illustrative: they do not constitute an offer of a finished product and are not part of the scope, unless the quote expressly includes them.

3. Quote and scope

  • Blinq does not publish fixed rates. Each project is quoted individually after a free, no-obligation assessment.
  • After the assessment, Blinq sends the written proposal — scope, timeline and price — usually within the following 24 business hours.
  • The quote is valid for 15 calendar days from when it is sent. After that period a new one must be issued.
  • The project scope is exactly what is described in the accepted quote. Any feature, page, integration or piece not listed there constitutes additional scope and is quoted separately.
  • Acceptance may be recorded in writing, by email or by WhatsApp message, and is deemed completed with the first payment.

4. Prices and payment terms

  • 50/50 structure: 50% of the price to reserve the spot on the schedule and start the project, and the remaining 50% upon delivery of the finished, approved project.
  • Blinq does not request 100% of the price upfront under any circumstances.
  • On larger projects, a milestone payment may be agreed, in which each installment is tied to a verifiable deliverable.
  • The 50/50 structure carries no surcharge. Any other split of the payment, including milestone payments, carries a 10% surcharge on the total price, unless the quote states otherwise.
  • The monthly care plan for websites is paid month to month, on the dates indicated in the quote (section 10).
  • The payment plan does not extend beyond the project's delivery date.
  • The agreed prices are not subject to discounts once the quote has been sent and accepted.
  • Prices are expressed in Colombian pesos (COP) or US dollars (USD) as indicated in the quote.

4.1. Late payment

  • If the final payment is not received within 10 calendar days of the delivery notice, Blinq may suspend the pending work and postpone the handover until the situation is resolved.
  • During the suspension, the project remains on Blinq's infrastructure and ownership of the deliverable is not transferred (section 9).
  • After 30 calendar days without receiving the final payment, Blinq may terminate the contract, keeping the payments already received as compensation for the work performed.
  • Suspension for late payment creates no liability for Blinq for any damages the client claims to arise from the delay.

5. Payment confirmation

Every payment must be confirmed by sending the corresponding receipt via WhatsApp to +57 311 279 5688. The service does not start or resume without a received receipt. The enabled payment methods are detailed on the payments page.

Once payment is received, Blinq issues the client a written acknowledgment identifying the project, the amount and the date. Clients who require a specific tax document must say so before accepting the quote, so we can check whether it can be issued.

6. Delivery times

  • The estimated timeline is stated in the quote and starts counting from confirmation of the first payment and complete delivery of the materials the client is responsible for (section 8).
  • Timelines are good-faith estimates. Delays attributable to missing materials, approvals or responses from the client extend the timeline accordingly.

7. Revisions

Every project includes two rounds of revisions on the agreed scope. Additional rounds are billed separately, at the price stated in the quote. Revisions cover adjustments to what was agreed; they do not cover changes of concept, complete redesigns or features that were not quoted.

8. Client obligations

  • Deliver in a timely manner the content, copy, images, logos and access credentials needed to carry out the project.
  • Blinq does not do photo shoots. Photos of the business are provided by the client. If images generated with artificial intelligence are required, they are quoted separately.
  • Guarantee that they hold the rights to all material they deliver to Blinq, and answer for any third-party claim arising from its use.
  • Guarantee that they have the authorization of the data subjects, under Law 1581 of 2012, to share with Blinq the personal data of third parties — for example, their own customers or employees — included in the material, databases or documents they deliver, or mentioned in meetings. Blinq processes that data only to carry out the project and may analyze it with artificial intelligence tools under the conditions of section 8.3 of the Privacy Policy. If the client prefers that some material not go through those tools, they say so when delivering it and Blinq processes it by hand.
  • Appoint a single person responsible for approving deliverables, to avoid contradictory instructions.

9. Delivery, handover and intellectual property

  • During development, and until the final payment is received, the project remains hosted on Blinq's infrastructure under a temporary address.
  • Once the final payment is made, ownership of the deliverable is transferred to the client and the handover to the corresponding domain is carried out.
  • For brand identity projects, the files are delivered in editable and non-editable formats: native file, PDF and PNG, with the vector logo in its different color versions.
  • Blinq retains the right to display the work in its portfolio and promotional materials, unless the client requests otherwise in writing.
  • Blinq's own tools, components and systems reused in the project — including the point-of-sale system — remain Blinq's property; the client receives a license to use them, not ownership.

9.1. Acceptance of the deliverable

Once delivery is notified, the client has 8 calendar days to review the work and report in writing any observations about the agreed scope. After that period without observations, the deliverable is deemed accepted and later requests are treated as additional scope (section 3).

9.2. Backups and content

Once the handover is complete, the client is responsible for the content they publish and for keeping a copy of the delivered files. Blinq keeps backups of projects while the monthly care plan or the annual license is in effect (section 10), but that copy is an operational continuity service and does not replace the client's own archive.

10. Hosting, monthly care plan and annual license

Blinq hosts the projects it develops on its own infrastructure. Projects hosted on third-party servers are not accepted, since availability and support cannot be guaranteed on infrastructure Blinq does not manage. The only exception is the artificial intelligence assistant installed on a client's existing website (section 11): the assistant runs from Blinq's infrastructure, and the rest of the site remains the responsibility of the client or their provider.

10.1. Websites: monthly care plan

  • Landing pages, business websites and online stores are contracted as a one-time setup plus a monthly care plan.
  • The care plan includes hosting, the domain when Blinq manages it, the SSL certificate, backups and monitoring, running the artificial intelligence assistant with its conversation allowance, the agreed monthly improvements and a results report.
  • It is paid month to month, on the dates indicated in the quote.

10.2. 3-month minimum commitment

The care plan has a minimum commitment of 3 months counted from the launch of the site. Once that minimum is met, it continues month to month, with no new commitments.

The minimum exists because the first months are what turn a launch into results: we measure how real visitors behave, adjust copy and calls to action, fine-tune the assistant with the questions that actually come in and fix the details that only show up with use.

10.3. How to end the care plan

  1. Written notice. The client gives notice by email or WhatsApp at least 30 calendar days in advance. The care plan ends at the close of the monthly period in which those 30 days are completed; that last month is provided and paid in full.
  2. Never before the minimum. If notice arrives during the first 3 months, termination takes place when the minimum is met. If the client prefers an earlier handover, it is done once the remaining monthly payments to complete the minimum have been paid.
  3. All accounts settled. The handover requires the setup to be paid in full and the monthly payments to be up to date through the termination date.
  4. Delivery. Within 10 business days after termination, with all accounts settled, Blinq delivers the site files, an export of the contacts and requests received through the site and the assistant, and the copy and images provided by the client. If the domain is in Blinq's name, Blinq arranges its transfer to the client or their new provider. Blinq's own components are governed by the license of use in section 9.
  5. What stops working. On the termination date, the services that depend on Blinq's infrastructure stop being provided: hosting, artificial intelligence assistant, monitoring, backups, improvements and reports. Blinq coordinates the switch with the client's new provider so the site doesn't go offline, provided the new hosting is ready before that date.
  6. Backup copy. Blinq keeps a copy of the site for 30 calendar days after termination, in case the client needs it, and then deletes it.

10.4. Late monthly payments

  • If a monthly payment is not made within 10 calendar days of its due date, Blinq may suspend the service, after notifying the client through the registered contact channels. The service is reactivated when the client catches up.
  • After 30 calendar days of late payment, Blinq may terminate the care plan. The delivery in section 10.3 is made when the client pays the amount owed.

10.5. Termination by Blinq

Once the minimum is met, Blinq may also terminate the care plan with 30 calendar days' written notice, and makes the same delivery described in section 10.3.

10.6. Custom software: annual license

  • Custom software is hosted on Blinq's infrastructure under an annual license, renewable every 12 months counted from the launch date, which covers hosting, domain, SSL certificate, backups, monitoring, security updates and minor adjustments.
  • If the client does not wish to renew it, they give written notice at least 30 calendar days before expiration. When the license ends, and with all accounts settled, Blinq delivers what is provided in section 9 and an export of the client's data in a standard format, within the following 10 business days.
  • Failure to pay the renewal may result in suspension of the service, after notifying the client through the registered contact channels.

11. Artificial intelligence assistants

  • On Blinq websites, the assistant is included in the monthly care plan (section 10.1). For an existing website or for WhatsApp, it is contracted through an initial setup payment plus a monthly fee. Annual payment in advance is also available.
  • Each plan includes a monthly conversation allowance. Usage beyond that allowance is billed separately, at the rate stated in the quote.
  • The service runs as long as the monthly fee is up to date. If payment stops, the assistant stops running. To end it, the 30-day notice in section 10.3 is given; when it ends, Blinq delivers the export of the contacts it has received.
  • The costs of third-party services needed for operation — messaging providers, gateways, paid programming interfaces — are borne by the client when the client contracts them directly.
  • Serving customers on WhatsApp uses the official WhatsApp Business API, which has its own per-conversation cost based on Meta's rates. That cost is borne by the client and is stated in the proposal.
  • Artificial intelligence systems can produce inaccurate answers. The client is responsible for supervising their use in critical processes, and Blinq is not liable for decisions made solely on the basis of their answers.

12. Digital advertising

  • Campaign management covers what the quote indicates: strategy, campaign and audience setup, ad creatives, optimization and periodic results reporting.
  • Ad spend is not included in the price of the service. The advertising budget is paid by the client directly to the corresponding platform (Meta, Google or another), from their own account and with their own payment method. Blinq only charges for the management.
  • The ad accounts, pixels and associated assets are the client's property. Blinq operates on them with the access the client grants, and the client may revoke that access at any time.
  • Blinq does not guarantee specific business results — number of sales, cost per result, return on investment or message volume — since they depend on factors beyond its control, such as competition, seasonality, the client's offer and the platforms' algorithms.
  • Advertising platforms may reject ads, restrict or disable accounts under their own policies. Blinq is not liable for those decisions, although it supports the client in managing the appeal when possible.
  • 3-month minimum commitment counted from the activation of the first campaign. The first month is for setup — accounts, pixel, audiences and first creatives — and the following months are for data-driven optimization, because the platforms need that time to learn. Once the minimum is met, management continues month to month.
  • Management is billed in monthly periods and its continuity depends on payment being up to date. It ends with the 30-day notice in section 10.3, which never takes effect before the minimum is met. When it ends, Blinq delivers the final report and removes its access. The accounts, campaigns, audiences and pixels remain the client's.
  • Exit for Blinq's non-performance: if Blinq does not provide the agreed management or does not deliver the agreed reports, and does not correct it within 10 calendar days of the client's written notice, the client may end the management without paying the remaining months of the minimum.

13. Brand identity

  • The project includes the pieces indicated in the quote, for example: logo and its versions, color palette, fonts, brand guidelines and applications.
  • The quote states how many initial proposals are presented. The two rounds of revisions in section 7 apply to the proposal the client chooses.
  • Once the final payment is made, the client receives the economic rights to the chosen design, with the files described in section 9. Proposals not chosen remain Blinq's.
  • Trademark registration is not included, unless the quote says otherwise. Blinq does not guarantee that the brand can be registered or that the Superintendencia de Industria y Comercio (Colombia's trademark office) will grant its registration; we recommend that the client check for prior marks and file before investing in promoting it.

14. Warranty

Blinq makes the necessary revisions, within the agreed scope, until the result meets what was agreed in the quote. The warranty covers fulfillment of what was agreed and correction of technical defects attributable to Blinq. It does not cover changes of scope, redesigns due to a change of mind, failures caused by modifications made by the client or third parties, or outages of external services.

15. Cancellation

  • If the client cancels the project after it has started, the first payment is non-refundable, as it corresponds to the reserved spot and the work already performed.
  • If Blinq cannot complete the project for reasons attributable to it, it will refund the proportional part not performed.
  • Client inactivity for more than 60 calendar days without delivering materials or approvals entitles Blinq to terminate the project, keeping the payments received for the work done.
  • Termination of the monthly care plan and of the annual license is governed by section 10.

16. Limitation of liability

Blinq's liability to the client is limited, in all cases, to the amount actually paid for the contracted service. Blinq is not liable for loss of profits, data loss caused by third parties, or indirect damages arising from the use of or inability to use the deliverables.

17. Confidentiality

Blinq keeps confidential the commercial, technical and strategic information it accesses in connection with the project, and does not disclose it to third parties except as required by law. This obligation survives the end of the contract. The processing of personal data is governed by the Privacy Policy.

18. Force majeure

Neither party will be liable for non-performance resulting from force majeure or unforeseeable circumstances, including widespread failures of infrastructure providers, connectivity outages, natural disasters or acts of authority.

19. Changes

Blinq may update these Terms and Conditions. The date of the last update is shown at the top of the document. Changes do not affect projects already contracted, which are governed by the terms in force at the time the quote was accepted.

20. Governing law

These Terms are governed by the laws of the Republic of Colombia. For consumers, the applicable provisions of Law 1480 of 2011 (Consumer Statute) apply. Any dispute will first be resolved directly between the parties; failing that, it will be submitted to the competent courts of Colombia.

If the client is a consumer under that law and contracts remotely (for example, via WhatsApp or email), they may exercise the right of withdrawal within the five (5) business days following acceptance of the quote, unless the provision of the service has begun with their consent, under article 47 of Law 1480 of 2011.

These Terms are also published in English as a courtesy translation. If there are any differences between the two versions, the Spanish version prevails.
